Welcome to the Two-Minute Treasurer’s Tip Podcast. I am your host Cyndi Meuchel with MoneyMinder where we’re hoping to make your life as a volunteer way easier.
Dani writes: We have some homeowners that are out of compliance with our CC&Rs. What’s the best way to enforce those? There are a number of steps you might take in order to encourage compliance with your HOA rules.
It probably goes without saying that being pleasant and professional is a must. You know the old saying, you can attract more flies with honey than vinegar. You might consider that. Maybe to start with, an informal conversation is in order. It could be that the violation is just an honest mistake.
If that doesn’t work you might consider a written warning. Subsequent actions beyond that might be to levy fines, suspend rights & privileges. You might place a lien on the property, or worst-case scenario, gosh I hope you never have to do this, but you might have to take the matter to court.
Also make sure that you are fairly enforcing the rules. You have to treat everybody equally. And your rules have to comply with state and local laws and ordinances. The authority that an HOA has limits. Know those before taking action.
